Terms of Use for the National Traffic Safety and Environment Laboratory Website

I .

General Provisions

Persons (hereinafter referred to as 'Users') using the website (hereinafter referred to as 'the Website') managed and operated by the Independent Administrative Institution of the National Traffic Safety and Environment Laboratory (hereinafter referred to as 'NTSEL') are governed by the Terms of Use stipulated by NTSEL below.

Intellectual Property Rights

Ownership

Intellectual property rights regarding All contents, texts, images, data, information and other materials (hereinafter referred to as 'Contents') displayed or available on the Website, (including trademarks or copyrights (hereinafter referred to as 'Intellectual Property Rights') are the property of NTSEL or the designated owners and are protected by applicable intellectual property laws.

Authorized Use and Prohibited Use

Authority of the Website Administrator

NTSEL may modify, edit, translate, cancel, limit access or terminate these terms, the website, its contents or links on the Website at any time, with no liability, and with no prior notification at NTSEL's discretion. NTSEL may terminate the viewing, the registration or the use of the Website by a particular user for any reason including violations to these provisions at any time, with no liability, and with no prior notification at NTSEL's discretion.

IV.

User Obligations

1.	Compliance Users shall comply with all applicable laws in connection with its use of the Website.

Unsuitable Content and Conduct

Users shall not engage in conduct or submit to the Website any Content or other material that is illegal, inaccurate, misleading, for illicit purposes, infringing the rights of others, dilutive of the rights of others, defamatory, obscene or otherwise offensive. Users shall not cause damage, embarrassment or impart an adverse impact to NTSEL.

3.	Functional Compatibility Users shall not damage, corrupt, alter or virally infect the Website, the Contents or any information or telecommunication system of NTSEL.

4.	User Cooperation and Notification Users shall cooperate with all reasonable requests of NTSEL and will notify NTSEL promptly upon learning of any breach (including suspected cases) of these Terms of Use, abuse or unauthorized use of the Website.

Disclaimer

NTSEL has no obligation to monitor, control or restrict the use of the Website. Moreover, NTSEL has no obligation to verify any Content submitted by Users or to provide any registration or other information concerning the Contents.
The Website, its Contents and its links are provided on an "as is" basis and are used at the sole risk of the user, within the limits permissible by law.
NTSEL disclaims all warranties, express or implied, of any kind, regarding the Website including its Contents, hardware, software and links, with regard to its appropriateness for a particular purpose, legality, availability, accuracy, completeness, accessibility, compatibility, security and freedom from computer viruses.
NTSEL shall not be liable for any damages or losses, including direct, indirect, consequential, special, incidental or punitive damages and lost profits, in connection with use of the internet, the Website, its Contents or its links, regardless of whether resulting from contract, tort, strict liability or other cause.
This applies even if NTSEL has been advised of the possibility of such damages.

Indemnity

Users shall indemnify NTSEL, its affiliates, directors, employees and contractors from any, damages, liabilities, or expenses , including attorneys fees, arising in connection with Users' use of the Website, online conduct, breach of these Terms of Use or dealings or transactions with other persons resulting from use of the Website. Furthermore, these parties shall not be held liable for legal action or other claims resulting from such conduct.

Miscellaneous

Individual Terms of Use

In connection with User's use of Contents contained in certain areas of the Website, it may be necessary for Users to consent to policies or Terms of Use (hereinafter referred to as 'Individual Terms of Use') in addition to the Terms of Use set forth herein. Individual Terms of Use of any other website managed by NTSEL shall supersede these Terms of Use.

Dispute Resolution

With respect to any and all disputes arising out of or in connection with the Website or these Terms of Use, NTSEL and Users agree to negotiate in good faith and undertake reasonable efforts to cooperate with one another in order to achieve a mutually satisfactory resolution. NTSEL has no obligation to become involved in any dispute between a User and any other person.
The Website, these Terms of Use and any dispute arising in connection therewith shall be exclusively governed by and construed in accordance with the laws of Japan regardless of the basic principles of international law.
The courts of Japan shall have exclusive jurisdiction to adjudicate any dispute arising in connection with the Website or these Terms of Use and the Hachioji Branch of the Tokyo District Court shall exclusively preside over the first hearing of any legal proceedings. Such legal proceedings must be initiated no later than one year after the cause of action occurs. Users shall agree to the exclusive personal jurisdiction of the courts of Japan.

Modification of Terms of Use, Etc.

NTSEL reserves the right to modify these Terms of Use at any time without prior notice. Users' continued use of the Website subsequent to NTSEL's notice of modification of these Terms of Use shall constitute Users' acceptance of the amended Terms of Use.
Even in the event any provision of these Terms of Use is held to be invalid or unenforceable for any reason, the remaining provisions will remain in full force and effect.
User obligations pursuant to these Terms of Use shall not expire and shall continue after termination of the Website, Users' use of the Website, any User Contents on the Website, or these Terms of Use.
